English Legal Systems: Critically discuss the extent to which modern

“In the case of Isle of Wight Council v Platt [2017] UKSC 28 the Supreme Court had to decide what was meant by the phrase ‘fails to attend regularly’ in s.444(1) Education Act 1996. Explain with reference to this and other cases how judges decide the meaning of words in legislation.

Critically discuss the extent to which modern statutory interpretation allows the courts to depart from the words of the statute.” 

Include : introduction, definition of statutory interpretation and the reasons it is needed (poor communication/draftsmanship), mischief rule, literal rule, golden rule, purposive approach (and how this approach differs from the 3 traditional approached including how it allows judges to depart from words of act), paragraph on which method was used in Wight Council v Platt case and how it demonstrates statutory interpretation being used, conclusion. Have a case example for each approach to demonstrate how the approach has been used in the case, as well as use references throughout in order to make a bibliography

Creating a unit plan for year 5 English

Prepare a 6-week unit plan for a primary years (year 5) context using the unit plan format, including some required classroom resources for teaching, learning and assessment. Your rationale should include a justification of:

• the context and

• the curriculum design and educational theories of curriculum, assessment and reporting selected from a personal, professional and Christ-centred, Bible-based worldview and

• assessment choices, strategies and tools (pre-assessment, formal and informal feedback, and summative) and rubrics for making judgements and • the inclusive practices for student developmental needs and

• the range of strategies for reporting to students/carers, and

• the purpose of keeping accurate and reliable records of student achievement Students should engage with the process of thinking about and planning one unit of work. This unit plan is to be clearly focused on one core concept or enduring understanding related to a chosen learning area/subject and must include at least one summative assessment task. The plan will cover six weeks of year 5 classroom time for the selected subject.

You are to submit a completed unit plan including:

• assessment task sheet and guide to making judgements (rubric) for this task for students • teaching and learning resources necessary to scaffold one of your phases (photos may be necessary: please be aware that to assist with uploading to Turnitin, you may need to use a photo capture system such as ‘snipping tool’ or PDF photos to reduce file sizes) • at least one resource is to be included that provides differentiated options for students (This may mean you develop two different worksheets, or the resource has layered options for students). Please label this resource in your Appendix as- Differentiated resource. This unit plan should be a demonstration of best practice in planning and assessing for learning. This unit plan should demonstrate your understanding of the various components of the plan and you should focus your attention on:

a. understanding what should be included in each section of the plan – knowledge, skills & values & the application of knowledge, skills & values (Consider: how does the Christian perspective authentically develop in your plan? This may be through questioning, the assessment task or reflective assessment);

b. appropriate scaffolding and assessment for learning;

c. the inclusion of Key Questions throughout each activity;

d. developing authentic and meaningful connections between the different sections; e. including the name and reference of relevant resources that would be used but not produced; f. the inclusion of an appendix identifying resources (including differentiated resources) that were produced to support this plan including: a letter to parents/carers to communicate the intent of the unit and assessment task; a student task sheet for the assessment/unit with a rubric or guide to making your judgement Please write this for a year 5 class, in english- use ACARA for referencing and must use the content descriptors to match everything.

Your assignment:

Research an issue of social importance inspired by a text we’ve read in class (or another short story, approved in advance). For example, you could explore postpartum depression or feminism as inspired by “The Yellow Wallpaper,” PTSD or the treatment of veterans from “How To Tell a True War Story,” custody issues from “Popular Mechanics,” etc. You must make an ARGUMENT about the issue – for example, what is an effective treatment for postpartum depression? How can custody battles affect young children? Topics that are off-limits: politics/political parties, gun control/2nd amendment, marijuana legalization, immigration, religion, abortion, death penalty, animal rights, gay marriage. You will have two major grades for this assignment: The annotated works cited page (evaluated using the research documentation rubric; worth 15% of your course grade); and the final research paper (evaluated using the research rubric; worth 15% of your course grade). Sources: You must use at least EIGHT sources in your works cited page, and SIX of those sources need to appear in your final essay. These sources must be from peer-reviewed journals (to be found in library databases) and non-fiction, academic books, with the exception of the short story, which you may choose to use if you wish. Sources found via google or Internet searches are not applicable to academic research. You may certainly consult the internet for ideas on narrowing your topic, or to help you grasp some of the basics of your particular concept. However, you cannot use these in your essay, and they should be consulted for base-level knowledge only.

Format: This is a formal essay of at least 1,000 words, not including the works cited page. You should use parenthetical citations throughout, for example, (Mahoney 1).

Critically discuss whether using juries in English criminal cases is in any way beneficial.

 

Use a minimum of 7 citations. Make sure it is excellent and has strong arguments because it is for a law summative The concept of jury system has been in existence for some time, and its early use is associated with the Norman Conquest before it was introduced to Britain. However, it is worth pointing out that the use of the jury in the early days was different from how it is applied today (Pakes, 2017). In those days, jurors in England served as witnesses who offered valuable information concerning local affairs (Terrill, 2012). This has changed, so that jurors are now used as adjudicators, a role that was transformed significantly under the rule of Henry II.

At this point, juries would not report on events they had information about but were tasked with discussing the facts and evidence of the case as presented to them by the prosecution and defence in order to reach a verdict of guilty or not guilty. As a result of the changing nature of juries, there is a lot of evidence that their use in English criminal cases is no longer as beneficial as it used to be. This will be argued by demonstrating the inherent bias that jury members might have, the difficulty jurors in understanding legal language, as well issues that arise as a result the secrecy in the verdict process. First body paragraph: First reason that a jury system is not beneficial is because of Bias (ex. Racial bias) Second body paragraph: second reason is that there might be legal misunderstanding; sometimes juries do not understand the facts of the case. (examples to use to support this argument: (vicky pryce case, cheryl Thomas “are juries fair?” article) Third body paragraph: The third reason is because of secrecy in the verdict (potential human rights issue)
